Class Q Curtilage

We have just had our Class Q application under the new rules turned down.

The barn is approximately 30 meters from the road.  In our planning application we included a driveway from the road to the barn with parking for two cars at the top of the site as well as the same next to the barn.  We did this as we understood we need to show vehicular access to the property.

The application has been turned down as the curtilage area exceeded the size of the footprint.  We assume they have included the driveway as curtilage.  Could we resubmit the application with a footpath to the building and it be acceptable?  Any thoughts or experience of this using the new rules?

Class Q says

Q.3. —(1) For the purposes of Class Q, “curtilage” means the lesser of—
(a) the piece of land, whether enclosed or unenclosed, immediately beside or around the building on an established agricultural unit or former agricultural building (as the case may be), closely associated with and serving the purposes of that building, and
(b) an area of land immediately beside or around the building on an established agricultural unit or former agricultural building (as the case may be) no larger than the land area occupied by that building.

So this is probably why.
